There are some problems in the inefficacy contract system, such as the limitation of the system, the blur prescribing of void claiming right. Aiming at resolving these problems, this dissertation makes a deep discussion.
而在合同效力中的無(wú)效合同制度上,存在著現(xiàn)行制度的不夠詳盡、無(wú)效請(qǐng)求權(quán)規(guī)定模糊的問(wèn)題,針對(duì)此問(wèn)題,本文展開(kāi)了討論,在明確合同無(wú)效的概念范疇后,針對(duì)我國(guó)沒(méi)有無(wú)效與不生效的詳盡規(guī)定的區(qū)分,以比較法的方法對(duì)德、英等國(guó)的該項(xiàng)制度進(jìn)行了鑒介。
